FAQ

VCAT Expert Witness Reports in Wollert: common questions

Does a Wollert building dispute have to go through the Building and Plumbing Commission first?

Most do. You cannot apply to VCAT about a domestic building work dispute without a certificate of conciliation from the Building and Plumbing Commission's dispute resolution service (formerly DBDRV), confirming the dispute was not suitable for conciliation or was not resolved there. Injunctions are the one kind of application that does not need the certificate. Raise the defects with your builder in writing before you go to the service.

How does the report help at conciliation?

It hands the builder and the conciliation officer a list of specific defects to respond to, each with the requirement it fails and the fix. An assessor appointed by the service may inspect as well. Once a dispute reaches VCAT, an expert report on the defective or incomplete work, if one is available, should be attached to the application under the building disputes practice note.

Is the expert working for me or for VCAT?

You engage the expert, but their overriding duty is to VCAT. PNVCAT2 gives the expert witness a paramount duty to the tribunal that outranks any duty to the party paying, and the expert is not an advocate. The report records sound work as well as defects for that reason.

What has to be included in the report?

PNVCAT2 requires a list of all instructions, the documents reviewed, the expert's qualifications and experience, the facts and assumptions relied on, a summary of opinions, a note of anything outside the expert's field, and a signed declaration. Rectification recommendations must come with reasons, the likely cost and whether there is a reasonable alternative. We support each item with photographs, measurements and the clause it fails to meet.

Which requirements does the report test my Wollert builder against?

Section 8 of the Domestic Building Contracts Act 1995 implies warranties covering three things relevant here: that the work follows the contract plans and specifications, that it complies with the law including the Building Act 1993, and that it is done with reasonable care and skill. The National Construction Code and Australian Standards follow, including AS 2870 for slabs on Wollert's reactive basalt clay, AS 3740 for wet areas and AS 1684 for timber framing. For tolerances and finishes, the reference is the Guide to Standards and Tolerances.

Is my home judged by the 2015 Guide or the new one?

The contract date settles it. Contracts entered into, or work started, on or after 1 August 2026 come under the 2026 Guide, and for an earlier Wollert contract the 2015 Guide is the one used. Because the Guide is advisory, the contract, the law, the NCC or a standard takes precedence wherever they differ.

How long do Wollert owners have to bring a claim?

No building action can be brought more than 10 years after the occupancy permit, or after the certificate of final inspection on a build that never received an occupancy permit, according to section 134 of the Building Act 1993. Later owners benefit from the section 8 warranties too, so a second owner can rely on them within that 10 year period.

Will you work with the builder's expert?

If VCAT orders a conclave, yes. The experts meet, narrow their differences in good faith and file a joint report of what they agree on, what they do not and why, sometimes called a Scott Schedule. For a more complex hearing, expect the report to be taken as read and the experts possibly heard concurrently as a panel.

When is the report due?

Whenever VCAT's orders say it is due. Failing that, PNVCAT2 sets the deadline at 10 business days or more before the mediation, compulsory conference or hearing where the report is to be used, and it must be both filed and served by then. If it is late, VCAT can refuse it, so pass on your hearing and conference dates when you first get in touch.

Who carries out the inspection and writes the report?

An experienced building inspector inspects your home, works through the documents and signs the declaration PNVCAT2 requires. VCAT expects disclosure of the inspector's qualifications and of any relationship with you, and the report includes both.

Which areas around Wollert do you cover, and how is the fee decided?

We cover Wollert's estates, among them Lyndarum North, Mason Quarter, Fellow, Northborne, Rathdowne and Wollert Rise, and nearby Epping North, Epping, Mernda and Doreen. How many items are in dispute, how big the house is and how many documents there are decide the fee. A quote follows our reading of the contract and your defect list.
